# Discovery Flight Rental and Hold Harmless Agreement

This Discovery Flight Rental and Hold Harmless Agreement ("Agreement") is between NextGen Flying Academy LLC, doing business as NextGen Aviation Academy ("Company"), and **{{student.full_name}}** ("Participant") for an introductory flight in a Company aircraft at Riverside (KRAL), Redlands (KREI), or any other location. It covers only the discovery flight. Any further training or rental requires the Company's full Aircraft Rental and Hold Harmless Agreement.

## 1. What a discovery flight is
A discovery flight is a demonstration flight of roughly 30 to 60 minutes with an FAA-certificated flight instructor acting as pilot in command. Participant may handle the controls only under the instructor's direct supervision. It is not a course of instruction, and no pilot certificate, medical certificate, or citizenship verification is required.
## 2. Identification
Participant must upload a copy of a current government photo ID with this booking and present the original at check-in. Company will not dispatch a discovery flight without it. A copy is kept in Participant's file, encrypted, and viewed only by staff who need it.
## 3. Payment, scheduling, and cancellation
- The discovery flight is paid at the posted price before the flight. No deposit, account, or ongoing commitment is created by this Agreement.
- Flights are scheduled through Company's booking system or by phone during business hours. Participant is a no-show if not checked in within one half hour of the scheduled time without contacting Company, and the slot is released.
- A cancellation 48 hours or less before the scheduled time is billed per Company's current posted cancellation policy. No fee applies when Company cancels for weather or maintenance; Company will offer to reschedule.
## 4. Conduct
Participant agrees to follow all instructions of the flight instructor and Company staff before, during, and after the flight, and is prohibited from:
- Starting, taxiing, or flying within 12 hours after consuming alcohol, or while under the influence of alcohol or any drug (including cannabis and any medication that could affect safe operation), per 14 CFR 91.17.
- Smoking, or allowing smoking, in or near an aircraft.
- Consuming food or beverages, other than water, in an aircraft.
- Bringing pets or additional passengers without Company's written approval.
- Touching the controls, switches, or equipment except as directed by the instructor, or interfering with the operation of the aircraft in any way.
The instructor may end the flight at any time for safety, weather, or conduct reasons.
## 5. Fitness to fly
Participant confirms they have no medical condition that would make it unsafe to fly, will tell the instructor about any concern before departure, and is responsible for the reasonable cost of cleaning the aircraft interior if soiled during the flight, up to $500.
## 6. Accidents and incidents
In the event of an accident or incident, Participant will cooperate with the instructor, Company, Company's insurer, and the proper Federal, State, and Local authorities, and will not make statements about the event to anyone other than those parties.
## 7. Indemnity
To the fullest extent permitted by law, Participant will defend, indemnify, and hold harmless Company, the owners of any aircraft leased to or operated by Company, and their respective owners, officers, employees, instructors, and agents (the "Company Parties") against any loss, damage, or expense, including reasonable attorney's fees, arising out of Participant's breach of this Agreement or Participant's conduct during the discovery flight, except to the extent caused by the gross negligence or willful misconduct of a Company Party.
## 8. Assumption of risk and release
**Participant understands that flying in a general aviation aircraft involves inherent risks, including mechanical failure, weather, turbulence, airsickness, collision, and the risk of serious injury or death, and Participant voluntarily assumes those risks. To the fullest extent permitted by law, Participant releases and waives all claims against the Company Parties for injury, death, or property damage arising out of the discovery flight or use of Company facilities, including claims based on the ordinary negligence of a Company Party. This release does not apply to gross negligence, willful misconduct, or any claim that cannot be waived under California law.**
## 9. Photographs
Company may take photos or video during the flight for Participant's own keepsake. Any marketing use requires Participant's separate written consent.
## 10. Governing law and venue
This Agreement is governed by the laws of the State of California. Any action arising out of it will be brought in the state or federal courts located in Riverside County, California, and the prevailing party may recover reasonable attorney's fees and costs.
## 11. Severability, entire agreement, electronic signatures
If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect. This Agreement, with Company's posted price and cancellation policy, is the entire agreement about the discovery flight. It may be signed electronically, and an electronic signature has the same effect as a handwritten one (15 U.S.C. 7001; Cal. Civ. Code 1633.7).
